1. Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Hawana LLC ("Company," "we," "us," or "our"). By accessing or using our website, application, or services (collectively, the "Platform"), you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

Hawana LLC is a Wisconsin-based company in the United States, providing digital products and services, including eSIMs, virtual currency, video games, and multi-use or one-time use codes.

1.3 Updates to Terms
We may update these Terms from time to time to reflect changes in our services, technology, or legal requirements. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.

2. Description of Services

2.1 Digital Products and eSIM Reselling
Hawana LLC offers a range of digital products, including eSIMs, virtual currency, video games, and multi-use or one-time use codes. Users can register and purchase these products through our Platform. The Platform is designed to provide a seamless and secure purchasing experience.

2.2 Payment Processing
All payments for products and services on the Platform are processed securely through Shopify Pay. By making a purchase, you agree to Shopify Pay’s terms and conditions. Prices are listed in US Dollars ($) and include applicable taxes unless stated otherwise.

3. User Responsibilities

3.1 Account Registration
To access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for any activities or actions under your account.

3.2 Prohibited Activities
You agree not to use the Platform for any unlawful, illegal, fraudulent, or harmful purpose or activity. Prohibited activities include, but are not limited to:

  • Posting or transmitting content that is unlawful, defamatory, obscene, or otherwise objectionable.
  • Infringing on the intellectual property rights of others.
  • Engaging in fraudulent activities, including unauthorized transactions.
  • Attempting to interfere with the security or functionality of the Platform.

4. Product Usage and Limitations

4.1 eSIM Compatibility
It is your responsibility to ensure that your device is eSIM compatible and network-unlocked before purchasing an eSIM. By proceeding with a purchase, you confirm that your device meets these requirements. Hawana LLC is not responsible for issues arising from incompatible devices.

4.2 Activation, Viewing, and Usage
Digital products, including eSIMs, virtual currency, video games, and codes, must be activated, viewed, or used in accordance with the instructions provided. Once a product has been used, activated, or viewed, it is no longer eligible for a refund.

5. Refund and Return Policy

5.1 Refund Eligibility
Refunds are only provided if the digital product, eSIM, or code has not been used, activated, or viewed. Refund requests must be made through the refund module within three hours of purchase. Refunds will be processed back to the original payment method via Shopify Pay.

5.2 Non-Refundable Products
Once a digital product, including eSIMs, virtual currency, video games, and codes, has been used, activated, or viewed, it is non-refundable.

5.3 Support for Issues
If you experience issues with a product, please contact our support team at support@andalu.com. We are committed to resolving any concerns promptly.

6. Donations and Humanitarian Support

6.1 Partnership with WatermelonWarriors.io
Hawana LLC partners with watermelonwarriors.io to support humanitarian causes by providing eSIMs. Donations made through the Platform are used exclusively to cover server costs, distribute, and generate eSIMs for humanitarian purposes. Hawana LLC captures no profit from these donations.

6.2 Liability and Usage
Hawana LLC is not liable for the usage of eSIMs provided through donations. However, we fully support our partner in the distribution and activation of these eSIMs. Donors will receive a usage link once the eSIM has been distributed, typically within five days of the donation.

7. Intellectual Property

7.1 Ownership of Content
All content on the Platform, including text, graphics, logos, images, and software, is the property of Hawana LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or otherwise use any content from the Platform without our express written permission.

7.2 Trademarks
All trademarks, service marks, and logos used on the Platform are the trademarks of Hawana LLC or their respective owners. Unauthorized use of any trademark displayed on the Platform is strictly prohibited.

8. Limitation of Liability

8.1 General Limitation
To the maximum extent permitted by applicable law, in no event shall Hawana LLC, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use, or alteration of your transmissions or content.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located within Wisconsin for the purpose of litigating all such claims or disputes.
